These Terms of Service (“Terms”) govern your use of the Durable Human Coaching website, assessment, consultations, text messaging program, and coaching services (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. About the Services

Durable Human Coaching provides online strength training, nutrition, and habit coaching. Our website lets you complete a short assessment and book a free virtual consultation with a coach. Any paid coaching program you choose to join may be subject to an additional agreement, which will be provided before you enroll.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you confirm that the information you provide is accurate and that you are authorized to provide it, including the mobile phone number you submit.

3. Health and Fitness Disclaimer

Durable Human Coaching is not a medical provider, and our Services are not medical advice, diagnosis, or treatment. Always consult your physician or a qualified healthcare professional before starting any exercise, nutrition, or wellness program, especially if you are pregnant, have a medical condition, or take medication.

Physical exercise involves inherent risks, including the risk of injury. By participating in any training or following any guidance we provide, you acknowledge these risks and agree that you participate voluntarily and at your own risk. Stop exercising and seek medical attention if you feel pain, dizziness, or discomfort.

Results vary from person to person. We do not guarantee any specific outcome, including changes in weight, strength, body composition, or health.

4. SMS / Text Messaging Terms

Program name: Durable Human Coaching.

Program description: When you provide your mobile number and check the consent box on our website, you agree to receive recurring marketing text messages from Durable Human Coaching about products, services, scheduling, and appointment reminders at the phone number provided.

• Message frequency varies.
• Message and data rates may apply. Check with your mobile carrier for details about your plan.
• To opt out, reply STOP to any message. You will receive one final message confirming you have been unsubscribed, and you will receive no further messages unless you opt in again.

• Consent is not a condition of purchase.
• Mobile carriers are not liable for delayed or undelivered messages.

Your information is handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

5. Consultations and Scheduling

Consultations are booked through our online calendar. If you need to reschedule or cancel, please use the link in your confirmation message or contact us as early as possible.

6. Acceptable Use

You agree not to misuse the Services, including by submitting false information, submitting another person’s contact information without permission, attempting to interfere with the website’s operation, or using the Services for any unlawful purpose.

7. Intellectual Property

All content on the website and in our programs, including text, graphics, logos, workouts, and materials, is owned by Durable Human Coaching or its licensors and is protected by intellectual property laws. You may not copy, distribute, or create derivative works from our content without our written permission.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website will be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Durable Human Coaching and its owners, coaches, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, loss, or damage arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, in the twelve (12) months before the claim arose.

10. Indemnification

You agree to indemnify and hold harmless Durable Human Coaching and its owners, coaches, employees, and contractors from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Utah County, Utah.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Your continued use of the Services after an update means you accept the revised Terms.
